When enough privately owned land inside the area described is bought and transferred to the United States for park use, at no cost to the federal government, and the Secretary of the Interior agrees it is sufficient, the land will be set aside as Badlands National Park for the public to enjoy. This will only happen after the State of South Dakota first builds the highways described later.
