Title 16 › Chapter 1— NATIONAL PARKS, MILITARY PARKS, MONUMENTS, AND SEASHORES › Subchapter LXI— NATIONAL AND INTERNATIONAL MONUMENTS AND MEMORIALS › § 441i
The Secretary of the Interior may accept ownership of land or land rights inside the revised Badlands National Park boundaries under sections 3111 and 3112 of title 40. In return, and with the Secretary of Agriculture’s approval, the Interior Secretary may transfer ownership of lands of approximately equal value that were once set aside from the public domain within the Badlands Fall River soil conservation project, SD–LU–1. The Secretary of Agriculture may instead transfer lands of approximately equal value that the United States already owns in that project. These exchanges count as exchanges under title III of the Bankhead‑Jones Farm Tenant Act (7 U.S.C. 1011(c)) and must follow that Act. Once the United States accepts title to lands under this authority, those lands and any other lands the United States acquires inside the park become part of the park. Transfers may be made with any necessary limits or conditions for the public interest.
