The Trace and every paved road inside the Recreation Area, including roads built to secondary (lower) standards, are treated as forest highways under federal highway rules. States must maintain those forest highways. The Secretary of Transportation must reimburse states, from Department of Transportation funds for highway construction and maintenance, for some or all maintenance costs as far as the law allows.
