Title 16 › CHAPTER 1 — NATIONAL PARKS, MILITARY PARKS, MONUMENTS, AND SEASHORES › SUBCHAPTER CVIII — GAULEY RIVER NATIONAL RECREATION AREA › § 460ww–1
The Secretary must run the recreation area like other National Park units and follow the same laws. The Secretary must allow hunting, trapping, and fishing there under applicable Federal and State laws, but may, after talking with the West Virginia Department of Natural Resources, set times or places where those activities are closed for safety, wildlife, or visitor use. The Secretary must also allow the State to stock fish in waters inside the area after consulting with the Secretary. The Secretary may make reimbursable agreements with the State or local governments for rescue, fire, and law enforcement help. The rules in section 1278(a) apply to the area the same way they apply to river segments. To improve access, the Secretary may keep up and improve existing public roads and rights-of-way if doing so does not unreasonably harm scenic or natural values. The Secretary must build access, parking, and river access for whitewater and other uses just downstream of Summersville Dam when those facilities are not provided under section 460ww–4, subject to the memorandum of understanding in the next paragraph. The Secretary may buy or get land, with owner consent, up to one mile outside the area to build parking and related facilities and must manage those lands like the recreation area. To provide public river access on the north side at Woods Ferry, the Secretary must acquire needed lands or rights, build parking, and may offer low-cost shuttle service to limit environmental or visual impacts. Existing leases in effect on April 1, 1993 that allow use of roads may continue. Except for the Summersville downstream access, the Secretary cannot create other river access points until the Woods Ferry access requirements are met. After consulting other federal agencies that manage nearby lands or waters, the Secretary must sign a memorandum of understanding to identify lands those agencies control, to note which areas are tied to operating the Summersville project, and to set consistent management rules.
