Within 30 days after getting a notice from the Commission under section 5105(b) and after looking over the Commission’s finding, the Secretary must decide two things: whether the State failed to do what section 5104 requires, and if so whether the steps the State did not take are needed to protect the fishery. The Secretary must carefully consider the State’s comments, let the State meet and speak if it asks, and get comments from the Commission and the appropriate Councils. If the Secretary finds the State failed and the missing measures are needed, the Secretary must put a fishing moratorium in place in that State’s waters for the fishery. The moratorium must start on a date within 6 months after it is declared. If the Commission later withdraws its noncompliance finding under section 5105(c) and the State is then in compliance, the moratorium ends. The Secretary can make rules to carry this out. Rules may allow aquaculture fish under State rules and must allow keeping incidental catch in menhaden fisheries when discarding is impractical, the retained fish are not a large part of the catch, and keeping them won’t harm conservation. While a moratorium is in effect, fishing, landing, possessing, selling, transporting, or otherwise dealing in fish taken in violation is illegal, and blocking enforcement is forbidden. Violators face civil penalties under section 308 of the Magnuson‑Stevens Act (16 U.S.C. 1858), certain obstruction acts are criminal under section 309(a)(1) and (b) (16 U.S.C. 1859), and vessels, gear, and fish used in violations can be forfeited under section 310 (16 U.S.C. 1860). Authorized officers under section 311(b) (16 U.S.C. 1861(b)) or other designated persons may enforce the moratorium, and the Secretary may use federal or state personnel and equipment to help.
