Title 16 › Chapter 75— HIGH SEAS FISHING COMPLIANCE › § 5509
Vessels that do illegal high-seas fishing, plus their gear, supplies, cargo, and any fish or other sea life caught or kept (or the fair market value of those animals), must be turned over to the U.S. government unless the offense is one that can be handled with a simple citation under section 5506. The U.S. Attorney General can ask a federal district court to order the forfeiture. Customs rules about seizing, selling, and handling such property, and about asking for relief from forfeiture, apply. Officers serving in‑rem process under section 5506 must either pause that process or release any seized sea life. Seized sea life may be sold with court approval for at least fair market value, and the money is held by the court. Any sea life found on a seized vessel is presumed to have been taken illegally, but that presumption can be opposed with evidence.
