Title 16 › Chapter 84— HEALTHY FOREST RESTORATION › Subchapter VI— MISCELLANEOUS › § 6591d
Allows hazardous fuels reduction projects to be done under certain existing forest restoration rules, to be treated as categorically excluded from the environmental review law (Public Law 91–190, 42 U.S.C. 4321 et seq.), and to be exempt from a special administrative review under section 6515. Hazardous fuels reduction projects — forest treatments meant to lower wildfire risk and restore forest health (defined elsewhere) — must keep old-growth and large trees when appropriate, use the best available science to protect or restore ecological health, and be planned and carried out through a collaborative, open process that includes diverse local interests. Such a project may be part of a Collaborative Forest Landscape Restoration Program proposal. Projects cannot be larger than 3,000 acres. They must be prioritized in the wildland-urban interface, or if outside that area, limited to certain high-risk fire-condition areas, and only in places designated under section 6591a(b) as of March 23, 2018. No new permanent roads are allowed (existing permanent roads may be maintained), temporary roads must be closed within 3 years after project completion, and extraordinary-circumstance procedures in 36 C.F.R. §220.6 must be followed. The rule does not apply to National Wilderness Preservation System lands, lands where vegetation removal is banned by law or proclamation, congressionally designated wilderness study areas, or places inconsistent with the local land and resource management plan. Projects must follow that plan, include public notice and scoping, and the Secretary must report yearly on acres treated and send the report within 1 year after March 23, 2018 and each year after to the Senate Committees on Agriculture, Nutrition, and Forestry and on Environment and Public Works; the House Committees on Agriculture and on Natural Resources; and the Government Accountability Office.
