If a fishing boat, its gear, supplies, cargo, or any fish are used in breaking the fishing rules, they can be taken by the U.S. government. A U.S. district court can order the boat or fish to be taken if the Attorney General asks in a civil court case. After the court rules for the United States, the Attorney General can seize property not already held. The same customs rules about handling and selling seized property, what happens to sale money, and how penalties can be reduced or settled will be used. Officers serving the seizure papers must either pause the action or release seized fish. Fish can be handled by a court order or, if they spoil easily, under rules set by the Secretary or the department running the Coast Guard. It is assumed, unless shown otherwise, that fish found on a seized boat were taken in violation of the rules.
