Title 16 › CHAPTER 12 — FEDERAL REGULATION AND DEVELOPMENT OF POWER › SUBCHAPTER I — REGULATION OF THE DEVELOPMENT OF WATER POWER AND RESOURCES › § 823f
The law requires the Federal Energy Regulatory Commission to set up a faster process for approving and changing licenses for closed-loop pumped storage projects. Within 180 days after October 23, 2018, the Commission must write that rule and form an interagency task force with federal, state, and tribal representatives to coordinate permits. The goal is to issue a final license decision within 2 years after getting a complete application. Before any license is issued, the Commission must check the safety of dams and related structures. The Commission can waive other rules for parts of a project that are not dams, but must consult the U.S. Fish and Wildlife Service, the National Marine Fisheries Service, and the relevant State fish and wildlife agency, include conditions they require to protect wildlife, and set fees to repay those agencies for studies; those fees, subject to annual appropriations Acts, must be given to the agencies and can be used until spent. The Commission may add joint permittees or make nonmunicipal co-licensees with a municipality if the municipality keeps majority ownership. Agencies may work together on environmental reviews without that being treated as improper private talks, and they may join licensing proceedings if staff involved in the reviews are kept separate from staff in the proceedings. The Commission must hold a workshop within 6 months after October 23, 2018 about using abandoned mine sites for closed-loop projects, and must issue guidance for applicants within 1 year after October 23, 2018. The Commission must make rules saying what qualifies as a closed-loop pumped storage project for the fast process; those rules must include that the project causes little or no change to existing surface or groundwater flows and is unlikely to harm species listed as threatened or endangered. Nothing in the law takes away the Commission’s existing power to license these projects.
