A licensed company or public utility must pay up to $1,000 to the United States if it willfully fails, on time, to follow a Commission order, file a required report, give information or documents for an investigation, or have an officer appear at a hearing after a subpoena. The Commission sets the exact amount after giving notice and a chance to be heard. That fine is in addition to any other penalties the law allows. The fines go to the U.S. Treasury and can be collected in civil court where the person lives or does business, or where a licensee transacts business. U.S. attorneys must bring these cases under the Attorney General’s direction, and the cost of suing is paid from court expense funds. This rule does not apply to sections 824j, 824k, 824l, or 824m or rules/orders under them.
