Title 16 › CHAPTER 12 — FEDERAL REGULATION AND DEVELOPMENT OF POWER › SUBCHAPTER I — REGULATION OF THE DEVELOPMENT OF WATER POWER AND RESOURCES › § 796
Sets the exact meanings of words used in the chapter so people know how to read the rules. Public lands are U.S.-owned lands that can be given or sold to private parties under the public land laws and do not include reservations. Reservations are U.S. lands held back from private sale, such as national forests, Indian reservation lands, military reservations, and other lands held for public purposes, but they do not include national parks or national monuments. Corporation means any business organization or group, whether incorporated or not, and also receivers or trustees, but not municipalities. Person means an individual or a corporation. Licensee means anyone, a State, or a municipality licensed under section 797, including their assignees or successors. State means a State in the Union, the District of Columbia, or an organized U.S. Territory. Municipality means a city, county, irrigation or drainage district, or similar local government unit that can develop, transmit, use, or distribute power. Navigable waters are waters Congress can regulate for interstate or foreign commerce and that are or can be used to move people or goods, including interrupted parts and parts improved or recommended for improvement by Congress. Municipal purposes are any powers a municipality has under its state laws or charter. Government dam is a dam or similar work built or owned by the United States for federal purposes. Project is a complete power development unit (power house, dams, conduits, reservoirs, transmission lines to where it ties into the grid, related lands and rights). Project works are the physical parts of a project. Net investment means the original legitimate cost of a project (following the Interstate Commerce Commission’s 1914 classification where applicable), plus additions and improvements, minus certain reserves or surplus amounts accumulated from earnings. Commission and Commissioner mean the Federal Power Commission and one of its members. State commission means the state body that regulates electric rates. Security means stocks, bonds, notes, or other evidence of ownership or debt of a covered corporation. Small power production facility covers eligible solar, wind, waste, or geothermal sites and facilities that use biomass, waste, renewable, or geothermal resources as the main fuel and that total no more than 80 megawatts at a site; “primary energy source” excludes minimal fuel used for startup, testing, flame control, or to prevent outages that would harm public health or safety. Eligible solar, wind, waste, or geothermal facilities needed either an application or notice to the Commission by December 31, 1994, and had to start construction by December 31, 1999, or show reasonable diligence. Qualifying small power production facility and qualifying small power producer are those the Commission approves by rule. Cogeneration facility produces electricity plus useful heat or steam; qualifying cogenerator and qualifying cogeneration facility are those the Commission approves by rule. Federal power marketing agency is a U.S. agency that sells electric energy (not the Tennessee Valley Authority). Evidentiary hearings mean proceedings under sections 554, 556, and 557 of title 5. State regulatory authority is the same as State commission, except for utilities under TVA ratemaking authority, where it means the Tennessee Valley Authority. Electric utility means any person or federal or state agency (including entities described in section 824(f)) that sells electric energy, and it includes the Tennessee Valley Authority and each Federal power marketing administration. Transmitting utility means an entity (including those in section 824(f)) that owns, operates, or controls facilities used to transmit electric energy in interstate commerce or for wholesale sales. Wholesale transmission services means transmission used for the wholesale sale of electric energy in interstate commerce. Exempt wholesale generator has the meaning in section 79z–5a of title 15. Electric cooperative means a cooperatively owned electric utility. RTO (Regional Transmission Organization) and ISO (Independent System Operator) mean Commission-approved entities that control transmission facilities in interstate commerce and ensure nondiscriminatory access. Transmission organization means an RTO, ISO, independent transmission provider, or other Commission-approved group that operates transmission facilities.
