Title 18 › Part I— CRIMES › Chapter 113C— TORTURE › § 2340A
If someone outside the United States commits or tries to commit torture, they can be fined under federal law, jailed for up to 20 years, or both. If the torture causes a death, the person can be sentenced to death or to life in prison or to any number of years in prison. Federal courts can try the case if the accused is a U.S. national or if the accused is in the United States, no matter the victim’s or accused’s nationality. Someone who plots or agrees with others to commit this crime gets the same punishments (except they cannot get the death penalty).
