A person accused of a covered Federal offense can say they acted under duress if they were a victim of trafficking when the crime happened. Covered Federal offense — a level A or level B offense (see section 3771A). Victim of trafficking — meaning given in section 103 of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7102). If this defense is raised, records about it must be sealed on request until a conviction is entered. If convicted, not using the defense at trial does not stop the person from later saying at sentencing or in post‑conviction proceedings that they were trafficked and acted under duress, and it cannot be used to bar them from federally funded programs that help trafficking victims.
