Title 18 › PART II — CRIMINAL PROCEDURE › CHAPTER 237 — CRIME VICTIMS’ RIGHTS › § 3771A
Victims of human trafficking can ask a federal court to erase certain convictions or arrest records if the crime or arrest happened because they were trafficked. A person convicted of a non-violent federal offense (called a "level A" offense) can move to have that conviction thrown out. A person arrested for a level A offense can ask to have the arrest records expunged. A person arrested for a violent federal offense (called a "level B" offense) can ask to expunge the arrest only if the alleged conduct was caused by trafficking and the person was later acquitted, the government dropped the case, or the charge was reduced to a level A and then acquitted, dismissed, or vacated. Motions must be written, list the offense, describe the evidence, and include supporting documents. The government has 30 days to oppose. If it does, the court must hold a hearing within 15 days; if it does not, the court may hold a hearing within 45 days. The court decides by a preponderance of the evidence and must consider an affidavit or sworn statement from an anti-trafficking service provider or clinician; that statement can be enough if it is credible and no other evidence is available. If a conviction is vacated the judge must enter an acquittal and order all official records cleared. Expunged arrests are treated as if they never happened under federal law. Courts can also reduce prison sentences for covered prisoners if the court finds the offense resulted from trafficking and considers the usual sentencing factors (including those in section 3553(a)). No fees may be charged to file these motions. Motions and related papers are filed under seal and the movant’s identity must not be made public. The rules apply to past, present, and future arrests and convictions.
