Special agents at the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and other federal investigators the Attorney General assigns, may carry guns, serve federal warrants and subpoenas, and make arrests without a warrant when a crime happens in their presence. They can also arrest without a warrant for a felony if they have good reason to believe the person committed or is committing that felony. ATF special agents may seize property that the United States can take. The rules in the Customs laws about seizing, forfeiting, handling, and resolving claims over such property generally apply, unless they conflict with section 983 of title 18. The Attorney General can designate who carries out those customs duties. Firearms taken by forfeiture are handled under section 5872(b) of the Internal Revenue Code of 1986.
