Foreign documents kept outside the United States can be used as evidence in federal criminal cases if they are certified under section 3494 and the court, after hearing testimony gathered under a commission under section 3492, finds they meet the Federal Rules of Evidence for authenticity. Copies count the same as originals. If someone says a document is fake, that person must prove to the court it is not genuine. If a foreign document can be properly authenticated by other law, you do not have to use section 3494.
