When deciding whether to give someone probation, and if so how long and what rules it includes, the court must consider the factors listed in section 3553(a) as they apply. A probation sentence can later be changed, taken away, fixed, or appealed under sections 3564, 3565, rule 35 of the Federal Rules of Criminal Procedure, and section 3742 (including appeals that change a sentence outside the guideline range).
