It is a crime to knowingly build or pay for a tunnel that crosses the U.S. border unless the tunnel is authorized, known to the Secretary of Homeland Security, and open to ICE inspection. Builders or funders can be fined and jailed for up to 20 years. Owners who know about or recklessly ignore such tunnels on land they control can be fined and jailed for up to 10 years. Using one of these tunnels to smuggle people, goods (sec. 545), drugs, weapons of mass destruction (including biological), or members of terrorist organizations (sec. 2339B(g)(6)) causes the prison term to be doubled. Attempting or agreeing to do these crimes carries the same penalties as actually doing them.
