The President may only make a formal offer to change or keep U.S. duties, duty-free or excise treatment, import limits, or other trade barriers — including for services, foreign direct investment, and intellectual property — after getting a written summary of public hearings where people had a chance to speak about that item. For items on a special published list, the President also must get advice from the Commission, or wait until either a 6-month or a 90-day review period ends, whichever comes first. When deciding whether to make an offer and what to offer, the President must consider advice, information, or reports from the Commission, any advisory committee, and any organization that held those public hearings.
