When an investigation under section 2412 begins, the United States Trade Representative must ask the foreign country involved to meet and talk about the issues. The Trade Representative must get information and advice from the petitioner (if there is one) and from the appropriate congressional committees when preparing U.S. presentations for those consultations and for any dispute settlement steps. The Trade Representative may, after talking with the petitioner, delay asking for consultations for up to 90 days to check or improve the petition. Any time limits in section 2414 are extended by the length of that delay. The Trade Representative must publish notice of the delay in the Federal Register and explain the reasons to Congress in the report called for under section 2419(a)(3).
