The President may pay money to people who lose out because of a trade action if two things happen. First, the President acted under section 3105(a) about a foreign country. Second, that action is later found to violate the United States’ international obligations, including the WTO Agreement and the multilateral trade agreements (see paragraphs (9) and (4) of section 3501 for those terms).
