The President can change U.S. import duties. He may lower duties in stages, change rates, or add new duties. Under World Trade Organization (WTO) negotiations, the President may change any duty listed in Schedule XX if the United States agreed in a multilateral WTO deal and the tariff category was part of the Uruguay Round negotiations. The President may also fix technical mistakes in Schedule XX. These actions are subject to required consultations and any waiting periods. After the WTO Agreement takes effect for the United States, the President may find that a non‑WTO country is not giving fair trade benefits to the United States. After consulting the House Ways and Means Committee and the Senate Finance Committee, the President may raise that country’s duty on an article to the higher of the base rate or the bound rate in Schedule XX. The President must end any such increase either on the date he sets or when the WTO Agreement comes into force for that country, and he must publish the determination and the end date in the Federal Register. When the President updates the HTS to carry out Schedule XX, he must also proclaim the specific column 2 rates listed in Schedule XX for the matching subheadings. If two or more 8‑digit HTS subheadings share the same column 1 rate and fall under the Harmonized System rule, the President may combine them into one 8‑digit subheading (after required consultations and waiting periods); the new column 1 rate will be the common rate and the new column 2 rate will be the highest of the previous column 2 rates. This combining rule applies to subheadings that had the same column 1 rate on December 8, 1994, or later because of staged reductions.
