Title 19 › Chapter 24— BIPARTISAN TRADE PROMOTION AUTHORITY › § 3806
The 90-day prior notice rule does not apply when the United States negotiates trade deals under the World Trade Organization, with Chile, with Singapore, or to create a Free Trade Area of the Americas. Congress may not use a special procedural vote just because that 90-day notice was not given. For those talks, the President must, as soon as possible after August 6, 2002, tell Congress that negotiations are happening, explain the U.S. goals, and say if a new deal or changes are being sought. The President must also consult the relevant congressional committees and the Congressional Oversight Group before and after giving that notice.
