Allows the President to let certain goods from Nepal enter the United States duty-free if he decides Nepal meets U.S. eligibility rules and, after review, the goods are not harmful to U.S. industries. The goods must be made in Nepal, shipped directly from Nepal, and fall into specific tariff categories (for example certain handbags, luggage, carpets, knit and woven apparel, headwear, and related textile items). For apparel, Nepal must be shown as the country of origin using the rules in effect the day before February 24, 2016. The U.S. International Trade Commission must advise that the items are not import-sensitive. At least 35% of an article’s value must come from materials made in, or direct processing costs in, Nepal or the United States, but U.S. content counted toward that 35% cannot be more than 15%. Simple packing or mere dilution does not count as making the item in Nepal. Customs must check imports on January 1, April 1, July 1, and October 1 each year for illegal transshipment and report problems to the President. Congress found Nepal is very poor (per capita GNI $730 in 2014) and suffered a large earthquake in April 2015 that killed over 9,000 people and injured about 23,000. In 2015 Nepal’s exports were about $800,000,000, with India buying $450,000,000 and the United States importing about $80,000,000 (10% of Nepal’s exports). The President must set up, within 180 days after February 24, 2016, a program with Nepal to build export capacity, train banks on export finance, publish trade rules and forms online, and provide importer/exporter guides. The President must report to Congress within one year after February 24, 2016 and then every year on how the program and Nepal’s eligibility are going. Duty-free treatment ends after December 31, 2025. The rules take effect 30 days after February 24, 2016.
