The United States Capitol Police must have a General Counsel who reports to the Chief of Police and works as long as the Chief wants. The Chief hires the General Counsel under the hiring rules in section 1907(e)(1), after talking with the Capitol Police Board. The hire must be made regardless of political party and only based on the person’s fitness for the job. The Chief sets the General Counsel’s yearly pay, but it cannot be higher than the Chief’s pay minus $1,000. This does not change the status of the person who was serving as General Counsel on March 4, 2010.
