When a United States Capitol Police officer or employee leaves the force, they cannot get a one-time cash payment for unused compensatory time unless section 1313(c)(4) specifically allows it. For overtime done on or after March 4, 2010, the Chief may give exempt employees extra pay or compensatory time only if the Chief says special circumstances apply, sets a dollar value for that overtime, and makes sure the overtime pay plus regular pay in that pay period does not exceed the yearly pay cap when allocated across pay periods under Capitol Police premium pay rules. An "exempt individual" means an officer or employee who is either classified as exempt under regulations under section 1313 or whose annual pay rate is not set by law. The change was treated as if it had been part of the Legislative Branch Appropriations Act, 2003, but it does not apply to overtime performed before March 4, 2010.
