When asked under section 288b(a), the Senate Counsel must defend the Senate, its committees, and its members, officers, or employees in federal, state, or local civil cases or other proceedings that challenge official Senate actions or orders, including subpoenas. The Counsel may represent a Member, officer, or employee only if that person agrees.
