The Secretary may set aside up to 1 percent of the program funds that are not used for another part, to give technical help to States so they can meet certain goals. In fiscal year 2010, the Secretary must give grants to States that have shown strong progress on those goals. The Secretary decides who gets money and how much using State applications and any other fair criteria, which can include how much help a State needs. Any State that gets a grant must use at least 50 percent of it to give subgrants to local school districts. Those subgrants must be sized based on each district’s share of Title I, Part A funding from the most recent year. The 50 percent rule does not apply to grants for State consortia making assessments aligned to standards or to grants for improving early childhood care and education. States that get early childhood grants may still make subgrants to public or private groups for activities that match the grant’s purpose.
