Federal agencies must not create, run, or keep a federal database of personal information about people who get help under this law, students at those schools, or people in related studies. That ban covers systems that track individual students over time, like student unit record or education bar code systems. Exceptions: systems the Secretary or a contractor was using the day before August 14, 2008, if needed for programs under subchapters II, IV, or VII; and States or groups of States may make and keep their own student-tracking databases with data on enrollment, attendance, graduation and retention, student financial aid, and graduate employment outcomes.
