Title 20 › CHAPTER 28 — HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE › SUBCHAPTER IV — STUDENT ASSISTANCE › Part A — Grants to Students in Attendance at Institutions of Higher Education › subpart 4 — leveraging educational assistance partnership program › § 1070c–2
States must apply every year through the state agency that ran the program on July 1, 1985, unless the Governor names a different agency in writing. The application must give the information required by federal rules so the U.S. Education Secretary can decide on the payment. The federal government can pay up to 50 percent of student grants if the state’s program meets certain rules. The program must be run by one state agency. Grants can be no more than $12,500 or the student’s cost of attendance per academic year for full-time students and for campus-based community service work-study. No more than 20 percent of a state’s allotment may fund those community work-study jobs. Work-study grants go only to students who are otherwise eligible and must follow the federal campus-based work-study rules. Recipients must be chosen based on significant financial need using state criteria approved by the Secretary. Nonprofit colleges in the state must be allowed to take part, unless barred by the state constitution or a state law enacted before October 1, 1978. The state must pay the nonfederal share from new state funds above what it spent in the second fiscal year before it first got program funds. If a state’s allocation is partly for independent or less-than-full-time students, a fair share must go to those students. The state must keep its spending at least the three-year average (total or per full-time-equivalent). The state must use proper accounting, report to the Secretary as required, and after June 30, 1987 the nonfederal share must come from state funds. Students must be told these are Leveraging Educational Assistance Partnership Grants funded by the federal government, the state, and other partners. The Secretary will reserve the federal share from the state’s allotment and pay it in advance or by reimbursement, in installments, and can change the reservation if costs or the application change.
