Title 20 › CHAPTER 28 — HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE › SUBCHAPTER IV — STUDENT ASSISTANCE › Part E — Federal Perkins Loans › § 1087cc–1
Colleges must give students clear, written facts about any loan before giving the money. The school can put these facts in the loan application, the promissory note, or a separate form. The required disclosure covers 18 specific items. These include the school’s name and payment address; the loan amount; any fees and how they are paid; the interest rate; yearly and total borrowing limits; when repayment and interest start; possible repayment terms, minimum monthly payment, and penalties for default; the borrower’s total balance with that lender and an estimated monthly payment; options to consolidate or refinance; the right to prepay without penalty and situations when repayment may be delayed (including a short notice about the Department of Defense repayment program); a definition of default and its consequences (including credit reporting); how the loan may affect other student aid; costs for making or collecting the loan; notice about the future end of these loans; and notices comparing benefits and rates with loans under part D and options to consolidate into a Federal Direct Loan. Before repayment begins, the school must also give another written statement (under an agreement with the Secretary) that covers 9 items. These include the school’s contact info, the repayment start date, the estimated balance at that date (including any capitalized interest), the interest rate, fees during repayment, the full repayment schedule (first payment date, number, amount, and frequency of payments), consolidation options, the total projected interest if payments follow the schedule, and the right to prepay without penalty. All disclosures must be free. If a school fails to give them, the borrower still must repay the loan, cannot claim civil damages for the failure, and the Secretary’s payment obligations remain unchanged.
