Title 20 › CHAPTER 28 — HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE › SUBCHAPTER IV — STUDENT ASSISTANCE › Part D — William D. Ford Federal Direct Loan Program › § 1087i–1
The Secretary, working with the Treasury Secretary and the Director of the Office of Management and Budget, can buy or agree to buy certain federal student loans from eligible lenders when there is not enough loan money available. This power applies only to loans first given out on or after October 1, 2003 and before July 1, 2010. The government officials must set terms they think are best for the United States, and any purchase must not cause a net cost to the federal government (including loan servicing costs). Before buying any loans, they must put a notice in the Federal Register that explains the purchase rules, how they will decide the price, and how the purchases will avoid net cost. They may also buy certain rehabilitated loans bought by lenders under section 1078–6 in the same date range, as long as those loans are not in default, with the same cost and notice rules. If the Secretary buys loans, the money paid must be used to keep the lender in the federal student loan programs and to make new federal loans or to buy rehabilitated loans as allowed. The Secretary can keep a lender as the loan servicer only if the cost is no more than the government would pay and it is best for borrowers. Once a loan is bought, the guaranty agency loses its duties and insurance for defaults that happen on or after the purchase date. The Secretary must file quarterly reports within 60 days after each quarter from July 1, 2008 through September 30, 2010, showing how many loans and how much money was involved, broken down by lender, school category, and loan type. By February 15, 2011 the Secretary must give a detailed cost estimate for purchases from July 1, 2008 through September 30, 2010, including gross and net outlays and a per-$100 comparison with other loan programs. The Secretary must also give annual cost estimates by February 15 after each of the fiscal years 2008, 2009, 2010, and 2011. This buying authority ends on July 1, 2010.
