Title 20 › CHAPTER 28 — HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE › SUBCHAPTER IV — STUDENT ASSISTANCE › Part G — General Provisions Relating to Student Assistance Programs › § 1093
Lets the U.S. Department of Education run tightly watched trial programs that let colleges try out expanded distance learning by temporarily waiving some federal rules. The trials aim to give more students access, test how well online or remote courses work, find which laws or rules should change, and figure out the right level of federal student aid for distance learners. The Department can pick eligible colleges, college systems, or groups of colleges to join. Most schools that already qualify for federal programs may apply, but schools described in section 1002(a)(1)(C) cannot. Western Governors University is specially allowed to join and may get extra waivers, but it must still meet strong accountability checks. Schools that want in must apply and explain their plans, show they talked with their accreditor about quality, name which rules they want waived and why, describe the distance programs and students they will serve, and promise to cooperate with evaluations. In year one the Department may pick up to 15 participants. In the third year it may add up to 35 more if the trials look promising. The Department must publish who is chosen, what waivers they get, and what courses they will offer. It will review the trials every year, looking at goals, student types and progress, financial aid issues, technologies used, and problems from rules that were not waived. The Department must also report on results to Congress, give technical help, monitor enrollments, and work with accreditors and state regulators. Distance education here means learning where teacher and student are separated by time or place, including TV, audio or computer transmission, conferencing, videotapes, or correspondence.
