Title 20 › Chapter 33— EDUCATION OF INDIVIDUALS WITH DISABILITIES › Subchapter I— GENERAL PROVISIONS › § 1403
A State cannot use the 11th Amendment to avoid being sued in federal court for breaking the rules in this chapter. If a State is sued, the court can order the same kinds of fixes and awards—like money damages or court orders—that it could give against any other public agency. These rules cover violations that happen in whole or in part after October 30, 1990.
