If a State misses at least 90% of any of its own performance targets for the main CTE measures for all CTE concentrators, the State agency must make and carry out a program improvement plan the next program year. The plan must look at the gaps in performance and say what will be done to fix them, and it must be made with other agencies and groups. If the Secretary finds the State agency is not doing its duties or not making real progress—even after the plan—the Secretary will help enforce improvement. After notice and a chance to be heard, the Secretary may withhold some or all of certain federal funds if the agency fails to carry out the plan or fails to meet at least 90% of a target for the same measure for 2 consecutive years after being placed on improvement. The Secretary can waive the withholding for things like natural disasters or a sudden drop in State money. Money taken back must be used to give technical help, improve plans, or pay for other improvement activities. A State may not change its performance targets while it is working under an improvement plan. Every year, each eligible State agency must review local CTE programs using the local performance targets. If a local recipient misses at least 90% of any agreed local target for all CTE concentrators, that local program must make and run a program improvement plan the next program year. The State agency will work with any local recipient that is not doing its duties or not making progress. After notice and a hearing, the agency may withhold some or all of a local recipient’s funds if the recipient does not carry out its plan or misses at least 90% of a local target for 2 consecutive years after being identified. The agency can waive sanctions for things like disasters, a sudden drop in local funding, or when a very small program’s size affects results. Money withheld must be used to provide services to students in the area by other arrangements. A local recipient may not change its performance targets while it is under an improvement plan.
