The Foundation can hire people and pay them up to the General Schedule maximum for grade GS‑15. It can hire short‑term experts under section 3109 of title 5 and pay them no more than the GS‑18 rate in section 5332 of title 5. It can make its own rules for how it works. It can accept gifts and use or sell them for its purposes. It can take volunteers and pay their travel costs, including per diem, as allowed by section 5703 of title 5. It can make contracts and grants and, if two‑thirds of the Board agree, do so without performance bonds or following section 6101 of title 41. It can make advance payments without following 31 U.S.C. 3324(a) and (b), rent office space near Washington, run other programs about constitutional study, spend up to 5 percent of its yearly budget on fundraising, and make other necessary expenses. The Foundation must send an annual report to the President and to Congress. If the Chairman asks, a federal agency head may detail staff to the Foundation to help, and the Foundation does not have to reimburse the agency for those staff.
