From the yearly money set aside under section 7122, the Secretary must reserve 0.5% to pay outlying areas (shared based on their need), 0.5% for the Secretary of the Interior to use in Bureau of Indian Education schools, and 2% for technical help and building state capacity. The rest is split among States with approved plans. Each State’s share is based on the amount it got the prior year under subpart 2 of part A of subchapter I. No State may get less than 0.5% of that money, and Puerto Rico cannot get more than 0.5%. If a State loses its allotment, its money is reallocated to the remaining States using the same rules. To get funds, a State must send a plan when the Secretary asks. The plan must say how the State will use funds for statewide activities, show that local awards follow section 7115(a)(2), and promise to review and coordinate existing programs, monitor and help local agencies, and ensure fair access for all students while following other Federal laws.
