Title 20 › CHAPTER 3 — SMITHSONIAN INSTITUTION, NATIONAL MUSEUMS AND ART GALLERIES › SUBCHAPTER V — JOHN F. KENNEDY CENTER FOR THE PERFORMING ARTS › § 76q–1
It assigns who will plan, build, and manage a new plaza next to the John F. Kennedy Center and explains who controls roads, buildings, green areas, and air rights needed for the work. Key terms: air rights (rights to use space above streets), Center (the John F. Kennedy Center), green spaces (grass, trees, and plants), Plaza (the paved and landscaped area and utilities around the Center), Project (the Plaza work described in the TEA–21 report), Secretary (the Secretary of Transportation), TEA–21 report (the Secretary’s report to Congress). The Secretary of Transportation must lead the planning, design, engineering, and construction of the Project except for buildings on the Plaza. The Secretary must make agreements with the Center’s Board and other agencies, may sign contracts with Board approval, and must set up a Project Team with representatives from the Secretary, the General Services Administrator, the Board Chairman, and others. The Secretary appoints a Project Director for that team. The Board may build Plaza buildings using non‑appropriated funds, accept air rights from the District of Columbia, and acknowledge private gifts inside buildings only. The Mayor of the District of Columbia has exclusive power to change nearby highways and to convey land or air rights needed for the Project and must transfer needed interests to the Board without payment within 90 days after being notified. After completion, road and sidewalk care stays with the current owners, but the Board will own and maintain the Plaza’s buildings and green spaces. The Comptroller General must review Project management and report periodically to the House Committee on Transportation and Infrastructure and the Senate Committee on Environment and Public Works until the Project is finished.
