Public agencies that get federal education money must give private school students and their teachers fair special services when eligible children in their area need them. Before doing so, the public agency must talk with private school leaders in a timely and meaningful way to agree on services. The help must be nonreligious, neutral, and not promote any ideology. The services for private school children and staff must be as fair and as timely as the services for public school participants, and a State-designated ombudsman will watch to make sure that happens. Money set aside for private school services must match the number and needs of the children, must be used in the same fiscal year it is given, and private schools must get notice of how much is available. The agency can deliver services itself or hire others under contract. This rule applies to six federal programs, including Part C of subchapter I; Part A of subchapters II, III, and IV; Part B of subchapter IV; and Project SERV (section 7281). “Eligible children” means those who qualify under those programs. Consultation must cover how needs are found, what services will be offered, who will give them, how results will be checked, how big the program will be, how money is figured, and whether to pool funds or divide them by attendance area. If officials disagree about using a contractor, the agency must explain in writing. Private schools must sign a paper saying consultation happened or can file a complaint with the State. The public agency keeps control of the funds and any materials bought, staff or contractors must be independent of the private school and any religious group, and federal funds cannot be mixed with non‑Federal money.
