The Secretary must create and update guidance about what kinds of school prayer are allowed by the Constitution. The first guidance was due by September 1, 2002, and then it must be updated every two years. The guidance must be posted clearly on the Education Department’s website and checked first by the Department of Justice’s Office of Legal Counsel to make sure it matches current law. Local school districts must sign a written statement to their state education agency by October 1 each year saying no district policy blocks constitutionally protected prayer, using the guidance. States must tell the Secretary by November 1 each year which districts did not file the statement or have complaints. If a district does not certify or lied in its certification, the Secretary can issue rules or orders to make the district comply.
