Allows the Secretary to send inspectors into a factory, warehouse, or other place where electronic products are made or kept if the Secretary has good reason to think the testing methods or safety programs might not be reliable. Inspectors must show ID and a written notice, enter at reasonable times, and look only in the areas where tests required by section 360kk(h) are done. Inspections must be done promptly and reasonably. One example of “good reason” is if a manufacturer has sold a product that does not meet an applicable standard and no exemption under section 360ll(a)(2) or 360ll(e) was given. Requires manufacturers to keep testing records and other papers, make reports, and give information the Secretary reasonably asks to check compliance. Manufacturers must let authorized inspectors look at relevant books and records. They must also give performance and technical safety data the Secretary needs, and the Secretary can require that certain safety data be given to the first buyer at the time of sale after talking with the industry. Accident and investigation reports by the Secretary’s staff can be used in court and those staff may have to testify; reports made public need not name people, and research reports are public. Trade secrets and other protected information (see 18 U.S.C. 1905) are kept confidential except to government staff carrying out these rules or when needed in proceedings, and Congress committees may get the information. The Secretary may make rules requiring dealers or distributors of covered products with retail prices of $50 or more to give manufacturers information to find the first non-resale buyers for notification under section 360ll; dealers can instead hold the information until asked, must notify the manufacturer if they do so, must give the information if they stop selling the product, and manufacturers must treat that buyer information as confidential and use it only to notify buyers under section 360ll(a).
