Title 21 › CHAPTER 9 — FEDERAL FOOD, DRUG, AND COSMETIC ACT › SUBCHAPTER IX — TOBACCO PRODUCTS › § 387e
Owners or operators of any place in any State that makes, repackages, changes, or processes tobacco products must register with the Secretary each year by December 31. "Manufacture, preparation, compounding, or processing" includes repackaging or changing a product’s container, wrapper, or label to move it from the maker to the seller. "Name" means each partner for a partnership, or each officer and director and the State of incorporation for a corporation. New owners must register right away when they start. Any added establishment must be registered right away. If the Act is passed in the second half of a year, the Secretary can set a first registration date no later than 6 months into the next year. Foreign establishments must register under rules that let the Secretary check whether their products could be refused at U.S. entry. Registered places must be open for inspection and must be inspected at least once every two years starting from their registration. When registering, a person must give a list of all tobacco products they make for commercial sale. For products covered by a product standard or special review, include the marketing authority and copies of labeling. For other products, include consumer information, labeling, representative ads, and all ads if asked. If the registrant says a product is not covered by a product standard, they must give a short explanation if the Secretary requests it. Registrants must report twice a year, in June and December, any newly introduced products, any stopped or resumed products (with dates), and any major changes to previously submitted information. Anyone who wants to start selling a product that was not on the U.S. market as of February 15, 2007 must notify the Secretary at least 90 days before and explain why the product is substantially equivalent under section 387j and what they have done to meet section 387g. Products first sold after February 15, 2007 and before 21 months after June 22, 2009 must be reported no later than 21 months after June 22, 2009. The Secretary can exempt minor additive changes and must issue rules for those exemptions no later than 15 months after June 22, 2009. The Secretary may also set a uniform product identification system and will work with the Treasury Department to make forms less burdensome.
