§467f Federal Food, Drug, and Cosmetic Act Applications

Title 21 › Chapter 10— POULTRY AND POULTRY PRODUCTS INSPECTION › § 467f

Last updated Apr 5, 2026|Official source

Summary

Poultry and poultry products are handled under this chapter instead of the Federal Food, Drug, and Cosmetic Act when this chapter applies. But any powers the Federal Food, Drug, and Cosmetic Act gave before August 18, 1968 are not taken away. An authorized representative of the Secretary of Health and Human Services can use the detainer power in section 467a to enforce the Federal Food, Drug, and Cosmetic Act for any poultry carcass, part, or product that is outside an official establishment. In that rule, references to "the Secretary" mean the Secretary of Health and Human Services.
