The Secretary can use the powers in sections 642, 643, or 644 on businesses inside any State or organized Territory even if those businesses only operate locally and not in interstate commerce. This can happen after the Secretary talks with the advisory committee under section 661 and finds the State or Territory lacks equal law or is not enforcing it to carry out the chapter’s purpose, including allowing the Secretary or a rep to inspect business sites, records, inventories, and take reasonable samples. When that is true, the federal rules apply to those businesses the same as if they were engaged in commerce.
