Claims under section 1642c based on owning part of a company that is itself a U.S. national must be denied. A direct-ownership claim for loss from a nationalization or taking can be allowed if the company was not a U.S. national on the date of the taking, no matter what percent the owner held. An indirect-ownership claim can be allowed only if at least 25 percent of the company was owned by U.S. nationals at the time of the taking. These rules are subject to other parts of this subchapter. Any award for an allowed direct or indirect claim is based on the company’s total loss and paid to the owner in proportion to their ownership share.
