Title 22 › Chapter 8— FOREIGN SERVICE BUILDINGS › § 306
The Secretary of State must use the design-build way to deliver construction at U.S. diplomatic posts that had not received design or capital construction contracts by December 27, 2021, unless the Secretary tells the relevant congressional committees that design-build would not be appropriate. If the Secretary chooses a different method, a written notice with the reasons must be sent to those committees and can be included in any other required report about a new post. Within 180 days after December 27, 2021, the Secretary must also report to those committees how the Bureau of Overseas Building Operations will measure performance for design and construction, lifecycle cost, and building maintenance using GAO’s "Standards for Internal Control in the Federal Government."
