Senior Foreign Service appointments must be to a salary class set under section 3962, not to a specific job. Limited appointments cannot make up more than 5 percent of the Service. Members assigned to the Peace Corps are not counted. People with reemployment rights under section 3950 who are career Senior Executive Service appointees are treated as career members for this limit. Appointments by the Secretary of Commerce do not count toward the 5 percent. Normally only one person without section 3950 reemployment rights may have a limited appointment in Commerce, except an extra limited appointment may be made for a specific overseas post if no qualified career member is available and the person has unique qualifications. The Secretary must set up a recertification process like the Senior Executive Service one under section 3393a of title 5.
