The Secretary can, based on recommendations from the Foreign Service Grievance Board, an equal employment opportunity appeals examiner, or the Special Counsel of the Merit Systems Protection Board, and must when ordered by the Merit Systems Protection Board, do four things: recommend a Presidential promotion under section 3942(a); promote under section 3943; give Senior Foreign Service performance pay under section 3965(c); or grant within-class raises under section 3966 for those on the Foreign Service Schedule. In special situations set by regulation, the Secretary may make those promotions or pay changes effective retroactively, and may recommend retroactive Presidential promotions. This also applies when using authority under section 4005(b).
