Title 25 › Chapter 5— PROTECTION OF INDIANS › § 190
The Secretary of the Interior may sell small nonreservation or tribal tracts that are not needed for Indian administrative or allotment purposes, under the rules in title 40 and parts of title 41. Sales must be public auctions to the highest bidder and not below appraised value. Parcels may not exceed 40 acres or $2,000 in value. Buyers can pay survey costs if a survey is needed. Net proceeds go into the Treasury for the credit and benefit of the Indians.
