Provides grants to tribes and tribal groups that run Bureau-funded contract or grant schools to help pay necessary administrative and indirect costs. Each stand‑alone school must get at least $200,000 a year. The grant amount is a percentage of the tribe’s total Bureau elementary and secondary funding. That percentage is set by a formula that uses the tribe’s “direct cost base,” a fixed “standard direct cost base” of $600,000, a maximum base rate of 50%, and a minimum base rate of 11%. The formula is calculated to two decimal places. Grants are reduced by any other federal payments the tribe gets for the same administrative costs. Money for these grants is extra and does not reduce program funds. If Congress does not appropriate enough money, all grants are cut back proportionally. The Director of the Office of Indian Education Programs had to do studies within 120 days after January 8, 2002 to set the formula factors, with tribal consultation, onsite sampling, Inspector General input, and a report to Congress. The Secretary may include full funding requests in annual budgets, and funding for new schools in a budget request must be at least 10% of the amount requested for existing schools. Funds awarded can be pooled in one administrative account and remain available without year limit.
